David Hart and Marty Frenkel lead the Financial Services & Real Property Litigation Group and share their perspectives.

DAVID E. HART, shareholder, is the consummate courtroom practitioner, leveraging quick thinking, persuasive advocacy, and a pragmatic, business-minded perspective to achieve his clients’ goals and protect their interests in a broad range of contested matters. His determined efforts and natural affinity for the back-and-forth of litigation and negotiation have formed the foundation of his success, earning him a reputation as a go-to lawyer for the most complex and contentious disputes.

A member of the firm’s executive management committee, chair of the Complex Litigation group, and co-chair of the Financial Services and Real Property Litigation group, David has represented business and individual clients in matters that require not only the ability to drill down to the smallest details but also the vision to see how a case fits into a client’s broader circumstances and objectives. In state and federal courts, as well as in alternative dispute resolution forums, he collaborates closely with his clients to develop approaches best suited to achieving their goals as they define them.

David’s extensive experience encompasses a wide range of business disputes, real estate, mortgage, construction, and title matters, as well as bankruptcy and creditors’ rights cases. While he thrives in the crucible of the courtroom and relishes the opportunity to wield his formidable oral and written advocacy skills on behalf of his clients, David also seeks and attempts to create opportunities to spare them from the costs and disruption of protracted litigation whenever possible.

A frequent lecturer on title insurance, real estate law, and litigation topics, David has earned the respect of his colleagues – adversaries and allies alike – who have consistently recognized his professionalism and achievements. Among his many accolades, he was named a “Go To” lawyer in business litigation by Michigan Lawyers Weekly in 2023 and 2025. Also in 2025, David was recognized among America’s Top 100 Bet-the-Company Litigators®, a testament to the trust clients put in him to handle their most consequential matters.

Active in community and charitable organizations, David served on the Board of Trustees of The Valley School and is currently a board member and president of his synagogue.
